Dugout Master - Terms and Conditions

1. Acceptance of Terms
By registering for, accessing, or using Dugout Master LLC (“Dugout Master”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These Terms apply to all users of the Service, including but not limited to users who are registered account holders, visitors, or contributors of content.
2. Changes to Terms and Service Modifications
Changes to Terms: We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to check the Terms periodically for updates.
Service Modifications: We reserve the right to modify, suspend, discontinue, or change any feature or functionality of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability. We do not guarantee that the Service will be available at all times or that any particular feature will remain available.
3. Eligibility
To use Dugout Master, you must be at least 13 years old or have the consent of a parent or guardian. By creating an account, you represent and warrant that you meet these eligibility requirements.
Children's Privacy (COPPA Compliance): If you are under 13 years of age, you may only use the Service with the express consent and supervision of a parent or guardian. Dugout Master complies with the Children's Online Privacy Protection Act (COPPA) and will not knowingly collect personal information from children under 13 without verifiable parental consent. Parents or guardians who believe their child has provided personal information to us should contact us immediately at support@dugoutmaster.com.
4. User Accounts
- Registration: To access certain features of the Service, you must create an account by providing accurate and complete information during the registration process.
- Account Security: You are responsible for maintaining the confidentiality of your account login credentials. You agree to notify us immediately of any unauthorized use of your account.
- Account Termination: We may suspend or terminate your account at any time if we believe you are violating these Terms.
5. License and Use of Service
We grant you a limited, non-exclusive, non-transferable, and revocable license to use Dugout Master for personal and/or organizational purposes. You agree not to use the Service for any unlawful or prohibited purposes, including but not limited to:
- Attempting to reverse-engineer, decompile, disassemble, or modify the Service or any part thereof.
- Distributing, licensing, sublicensing, or reselling the Service without express written permission from Dugout Master.
- Engaging in any activities that may harm, interfere with, or disrupt the Service or the use of the Service by others.
- Harassing, bullying, threatening, or intimidating other users or third parties.
- Spamming, phishing, or transmitting malicious code, viruses, or other harmful software.
- Creating fake accounts, impersonating others, or providing false or misleading information.
- Using the Service for any commercial purpose or resale without authorization, except as explicitly permitted by your subscription tier.
- Collecting or harvesting information about other users without their consent.
- Violating any applicable local, state, national, or international law or regulation.
6. Membership Tiers and Payments
Solo Teams: A membership plan for individual teams.
Club Teams: A membership plan that allows users to manage multiple teams.
Pricing, billing details, and features for each membership tier will be provided at the time of registration or upon upgrading.
Refunds: All payments are final, and refunds are at our sole discretion unless otherwise required by law.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of your current billing period, and your plan will not auto-renew after that period ends.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the applicable subscription fee at the time of renewal unless you have cancelled your subscription.
Payment Failures and Grace Period: If your payment method fails or is declined, we will attempt to process the payment again. If payment continues to fail, we may suspend your account access after a reasonable grace period (typically 7-14 days). During the grace period, you will receive notifications about the payment failure and may lose access to premium features. If payment is not successfully processed within the grace period, your subscription may be terminated. You are responsible for ensuring that your payment information is current and valid. We are not liable for any loss of data or access resulting from payment failures.
7. Content Ownership and Intellectual Property
- User Content: Any content that you upload, post, or otherwise transmit through the Service (including but not limited to team data, game schedules, and other media) remains your property. You grant Dugout Master a worldwide, non-exclusive, royalty-free license to use, distribute, and display such content as necessary to provide the Service.
- Dugout Master Content: All content provided by Dugout Master, including but not limited to software, design, graphics, and logos, is the intellectual property of Dugout Master and its licensors. You may not use, reproduce, or distribute this content without express written permission from us.
8. User-Generated Content and Video Embedding
Video Links and Embedding: Users may share links to videos from platforms such as YouTube, TikTok, and other video hosting services. By sharing such links, you represent and warrant that:
- You have the right to share the content and that sharing it does not violate any third-party rights or applicable laws.
- The content is not illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- You understand that Dugout Master does not claim ownership of linked videos and that such content remains the property of its original creators and hosting platforms.
- You will not share content that infringes on intellectual property rights, including copyrights, trademarks, or other proprietary rights.
Content Moderation: We reserve the right to review, remove, or disable access to any user-shared content that we determine, in our sole discretion, violates these Terms or is otherwise inappropriate. We may remove content without prior notice if we believe it violates our policies or applicable laws.
Third-Party Services and Content: The Service may contain links to or allow embedding of content from third-party services (such as YouTube, TikTok, and other video hosting platforms). Dugout Master is not responsible for the content, accuracy, opinions, or practices of any third-party services or websites. Your use of third-party content is subject to the terms and conditions of those third-party services. We do not endorse, warrant, or assume liability for any third-party content, products, or services. You acknowledge that Dugout Master has no control over third-party content and that your use of such content is at your own risk.
9. Privacy and Data Collection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Dugout Master LLC ("Dugout Master"), you consent to the collection and use of your data as outlined in the Privacy Policy.
Data Retention: We will retain your personal information and account data for as long as your account is active or as needed to provide you with the Service. If you delete your account, we will delete or anonymize your personal information in accordance with our Privacy Policy, typically within 30 days of account deletion. However, we may retain certain information as required by law, for legitimate business purposes, or to resolve disputes. Some information may remain in our backup systems for a limited period. 10. DMCA Safe Harbor and Copyright Protection
Digital Millennium Copyright Act (DMCA) Compliance: Dugout Master respects intellectual property rights and complies with the DMCA. We will respond to valid copyright infringement claims and take appropriate action as required by law.
Copyright Infringement Claims: If you believe that content on our Service infringes your copyright, please provide us with a written notice containing:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information sufficient to locate the material.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
- A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
Takedown Process: Upon receipt of a valid DMCA takedown notice, we will promptly remove or disable access to the allegedly infringing content and notify the user who posted the content. We may also terminate accounts of repeat infringers in appropriate circumstances.
Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification. We will restore the content unless the original complainant files a court action within 10 business days.

11. Limitation of Liability
To the fullest extent permitted by law, Dugout Master, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all damages, losses, or causes of action exceed the total amount you have paid to Dugout Master in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
12. Disclaimer of Warranties
Dugout Master is provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we make any guarantees about the accuracy or reliability of the content available on or through the Service.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Arizona, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the use of the Service will be subject to the exclusive jurisdiction of the courts located in Phoenix, Arizona.
14. Termination
We reserve the right to terminate or suspend your access to the Service without prior notice if we believe you have violated these Terms or for any other reason, at our sole discretion.

Dugout Master uses analytics and monitoring tools to improve our services, monitor site performance, and enhance your experience. These may include:

You agree to indemnify, defend, and hold harmless Dugout Master, its owners, employees, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from: (a) your use of the Service; (b) your violation of these Terms and Conditions; (c) your violation of any rights of another party, including intellectual property rights; (d) your violation of any applicable laws or regulations; or (e) any content you submit, post, transmit, or make available through the Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
